These terms govern your use of jamjar.red, halfhandhorror.com, and all related services operated by JAMJAR Entertainment, LLC. By accessing these sites or purchasing content, you agree to these terms. Half Hand Horror is intellectual property owned and operated by JAMJAR Entertainment, LLC.

Content and intellectual property

All written content, illustrations, photography, audiovisual works, source code, and design elements published on our sites are the intellectual property of JAMJAR Entertainment, LLC or its licensed contributors unless otherwise attributed, and are protected under the Copyright Act of 1976 (17 U.S.C. § 101 et seq.), the Digital Millennium Copyright Act (17 U.S.C. § 512), the Lanham Act (15 U.S.C. § 1051 et seq.), and applicable international treaties including the Berne Convention for the Protection of Literary and Artistic Works. All rights not expressly granted herein are reserved.

No content may be reproduced, distributed, transmitted, displayed, modified, or republished in any form or by any means: electronic, mechanical, photocopying, recording, or otherwise, without prior written consent from the author(s) or an authorized representative of JAMJAR Entertainment, LLC. The creation of derivative works based on protected content, and the redistribution or sharing of any content gated by subscription or access control, is strictly prohibited and constitutes infringement under 17 U.S.C. § 106.

Unauthorized use of protected materials may result in the issuance of a formal cease and desist notice, a takedown request pursuant to the DMCA (17 U.S.C. § 512(c)), and/or civil action seeking injunctive relief, statutory damages, and recovery of attorneys' fees as provided under 17 U.S.C. § 504 and § 505. JAMJAR Entertainment, LLC reserves the right to pursue all available legal remedies.

License Grant

Purchasing a Day Pass or subscribing to a Monthly Pass grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and read the content made available through that purchase. This license is granted solely for your personal, non-commercial use. It does not confer ownership of any content, nor does it grant any right to reproduce, distribute, publicly display, publicly perform, sublicense, or create derivative works from any content, in whole or in part, except as expressly permitted under these Terms or applicable law.

Membership and subscriptions

  • Monthly Pass — The Monthly Pass is a recurring subscription billed at $6.99 per month. It provides access to all current and archived content for the duration of the active billing period. Your subscription will automatically renew at the beginning of each billing cycle unless cancelled prior to the renewal date. You may cancel at any time through your account settings, accessible via the membership login on the landing page. Cancellation takes effect at the end of the current billing period; access to content will continue through the remainder of the period for which payment has been received.
  • Day Pass — $3.99, one-time, non-recurring purchase of $3.99. Upon purchase, the current week’s story will be delivered to the email address associated with your account. Access expires twenty-four (24) hours from the time of delivery. No automatic renewal or recurring charges will result from a Day Pass purchase.

All payments are processed through Stripe, Inc. (“Stripe”). By completing a purchase, you agree to be bound by Stripe’s terms of service. JAMJAR Entertainment, LLC does not store, process, or have direct access to your full payment card information.

Refund Policy

Monthly Pass subscriptions may be cancelled at any time; however, no refunds or credits will be issued for partial billing periods. Day Pass purchases are non-refundable once purchased since the token authorization for access it granted upon purchase. Please aware of what's being purchasing before authorizing payment. If you experience a technical issue that prevents access to purchased content, contact us at support@jamjar.red and we will, at our discretion, make content accessible or issue a refund.

Account conduct

By creating an account and using our services, you represent and warrant that you will:

  • Provide accurate, current, and complete information during registration and maintain the accuracy of such information
  • Maintain the confidentiality and security of your login credentials and accept responsibility for all activity occurring under your account
  • Not share, resell, sublicense, or otherwise redistribute any purchased or subscription-gated content
  • Not circumvent, disable, or otherwise interfere with any paywall, access control, digital rights management, or security feature of the site
  • Not use any automated tool, bot, spider, scraper, or similar technology to access, download, index, or reproduce site content without prior written authorization

JAMJAR Entertainment, LLC reserves the right to suspend or terminate any account that violates these provisions, with or without notice, and to pursue any available legal remedies.

User-generated content

If you submit comments or other user-generated content (“User Content”) through our sites, you retain all ownership rights in your User Content. By posting User Content, you grant JAMJAR Entertainment, LLC a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, display, reproduce, and distribute your User Content in connection with the operation of the site and related services. This license terminates with respect to any specific User Content upon its removal from the site, except to the extent that copies or derivatives have already been distributed or archived in ordinary course.


We reserve the right, but are not obligated, to monitor, edit, or remove any User Content that we determine, in our sole discretion, to be abusive, defamatory, obscene, in violation of third-party intellectual property rights, spam, or otherwise inconsistent with these Terms.

ALL CONTENT PUBLISHED ON OUR SITES — INCLUDING BUT NOT LIMITED TO FICTION, COMMENTARY, AND ANALYSIS — IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS FOR ENTERTAINMENT AND INFORMATIONAL PURPOSES ONLY. JAMJAR ENTERTAINMENT, LLC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF CONTENT. NOTHING PUBLISHED ON OUR SITES CONSTITUTES PROFESSIONAL, LEGAL, MEDICAL, FINANCIAL, OR OTHER SPECIALIZED ADVICE.


Our horror fiction is fiction. The stories are not real. Probably.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JAMJAR ENTERTAINMENT, LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) OUR SITES OR SERVICES, WHETHER BASED IN WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF JAMJAR ENTERTAINMENT, LLC FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SITES OR SERVICES EXCEED THE TOTAL AMOUNT PAID BY YOU TO JAMJAR ENTERTAINMENT, LLC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless JAMJAR Entertainment, LLC, its officers, directors, members, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (a) your use of our sites or services; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any User Content you submit or post.

Modifications to these Terms

JAMJAR Entertainment, LLC reserves the right to modify, amend, or replace these Terms at any time, at its sole discretion. The effective date of the most recent revision will be posted at the top of these Terms. Material changes will be communicated via email to active subscribers at least fourteen (14) days prior to taking effect. Your continued use of the site following the posting of revised Terms constitutes your acceptance of and agreement to be bound by those changes. If you do not agree to the revised Terms, you must discontinue use of the site and cancel any active subscriptions.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect.

Entire Agreement

These Terms, together with any applicable Privacy Policy and any supplemental terms or policies referenced herein, constitute the entire agreement between you and JAMJAR Entertainment, LLC with respect to the subject matter hereof and supersede all prior or contemporaneous communications, understandings, and agreements, whether written or oral.

Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof shall be resolved exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to the personal jurisdiction and venue of such courts.
